TERMS OF USE

1. What We Sell

We sell online wedding-dance products, including a general Wedding Dance Course, a library of pre-recorded choreographies set to specific songs, and new choreography created in response to a customer's chosen song and order details. Products may include demonstration videos, step-by-step lessons, lifts, dips, step options, music cuts, and optional practice-video feedback.

2. Eligibility and Payment

Customers must be at least 18 years old. All purchases are one-time purchases paid in full upfront. There are no recurring fees or automatic subscriptions. Prices are charged in U.S. dollars (USD). Currency conversion and any related bank or payment-provider charges are handled by the customer's bank or payment provider. Applicable taxes are included in the displayed checkout price.

3. Accounts and Access

Customers create a personal account through Thinkific. Wedding Dance Course and song-library purchases include unlimited access for 2 years from the purchase date. New choreography orders include unlimited access through the wedding date supplied with the order. If the wedding date changes, the customer may contact us to request an access extension to the new wedding date. If a customer has an access problem, they must contact

[email protected] so we can restore access or provide a new access link.

4. Correct Contact Information

Customers are responsible for providing the correct full name and email address at checkout and for checking their inbox and junk/spam folders for confirmations, access information, and choreography-delivery emails. If a customer enters an incorrect email address, the customer must contact us with the correct address. We are not responsible for proactively locating or contacting a customer who supplied incorrect contact information.

5. Personal, Non-Transferable Use

Every purchase is for the private use of the purchasing couple only and is non-transferable. Customers may not give, sell, transfer, or share access with another couple, friend, dance teacher, choreographer, studio, business, creator, or other third party. A purchasing couple may learn and perform the dance themselves and may share videos of themselves performing their First Dance.

6. Login Sharing

Account credentials may not be shared. If we reasonably determine that a login has been shared or transferred in violation of these Terms, we may immediately remove access without a refund, subject to rights that cannot legally be excluded.

7. Intellectual Property

Our instructional videos, choreography, teaching materials, written instructions, PDFs, diagrams, lesson notes, branding, graphics, and other original materials are owned by or licensed to First Dance by Zienna LLC and are protected by applicable intellectual-property laws. Purchasing a product gives the purchasing couple a limited, personal right to use the material for their own First Dance. It does not transfer ownership of our choreography or materials.

8. No Copying, Recording, Sharing, or Commercial Use

Customers may not download, screen-record, film, copy, screenshot, capture, reproduce, post, distribute, teach, resell, license, or otherwise share any instructional video or teaching material, including short clips or screenshots. Video lessons are streaming-only through the authorized account. Commercial use by dance teachers, studios, choreographers, creators, businesses, or other professionals is prohibited. Violations may result in immediate termination of access without a refund and legal action to protect our rights.

9. Customer Wedding Videos

Customers may film and share videos of themselves performing their First Dance, including on personal social media and in wedding films. This permission does not allow customers to share our instructional videos, lesson materials, or account access.

10. Library Choreography Is Non-Exclusive

Choreographies in our song library may be sold to and used by multiple couples. Purchasing a library choreography does not make that choreography exclusive to the purchasing couple.

11. New Choreography Is Also Non-Exclusive

A new choreography is created in response to the customer's chosen song and order details, but the choreography itself remains the intellectual property of First Dance by Zienna LLC and is not sold on an exclusive basis. We may add that choreography to our library and make it available to other customers 30 days after the original purchasing couple receives it. We will not use the customer's personal wedding or practice videos publicly without appropriate consent.

12. New Choreography Process

Our team begins working on new choreography orders immediately after purchase. Standard delivery is normally 3-4 weeks. Express delivery is within 10 days. The customer is responsible for selecting an option whose delivery timeframe works with their wedding date. The choreography process is not collaborative or co-created. Our team creates the finished choreography using the order details, the music, and our professional judgment.

13. Song Choice and Version

Customers are responsible for supplying the correct song and correct version of the song. For a standard new choreography order, the customer may change the song within 3 days of purchase. Express orders cannot change songs after purchase. If the customer supplies the wrong song or version and does not correct it within the permitted period, the customer is responsible for that mistake.

14. Choreography Length and Music Editing

New choreography is created to approximately the 2-minute mark, with a maximum choreography length of 2 minutes 30 seconds. We do not choreograph an entire longer song. The included music editing is a standard cut and fade only; we do not rearrange verses, choruses, or sections in a DJ-style edit. Customers may provide their own professionally edited or DJ-made track, provided the choreography remains within the 2:30 maximum. Where an MP3 music cut is provided, the customer may download it for personal wedding use only. We do not grant ownership, copyright, or music-licensing rights in the underlying song.

15. Requested Moves and Style

Customers may request moves they have seen on First Dance by Zienna's own social media. We will try to include requested moves naturally where they suit the music, flow, and couple, but we do not guarantee every requested move will be included. We do not copy choreography supplied from other choreographers, competitors, or dance companies. Customers should review our social-media examples before ordering because they show the general style of choreography we provide.

16. Lifts, Dips, Preferences, and Step Substitutes

Unless the customer tells us otherwise before the choreography is created, a new choreography may include lifts and dips. Customers may request no lifts, no dips, or both. Important style preferences, physical limitations, and movements the customer does not want must be provided before creation begins. New choreography does not include general revisions or a full redesign after delivery. If a particular movement does not work for the couple, they may request a reasonable step substitute, including an alternative to a lift or dip.

17. No Refund for Style Preference or Change of Mind

Because new choreography is created using the customer's submitted details and our established style and professional judgment, changing your mind about the style or simply not liking the finished choreography does not by itself create a right to a refund or full redesign. Customers are responsible for providing important preferences before creation begins. This section does not limit rights that applicable law says cannot be excluded.

18. Our Mistakes

If First Dance by Zienna makes an actual error - for example, we choreograph to the wrong song even though the customer supplied the correct song - we will correct our mistake at no additional charge.

19. Refund Policy - Ready-to-Go Products

For eligible non-custom products, including the Wedding Dance Course and ready-to-go song-library products, a customer may request a refund within 3 days of purchase, provided the customer has accessed or completed no more than 20% of the purchased course or content. Refund requests must be sent to [email protected]. Duplicate purchases of the same product may be refunded when the customer contacts us.

20. Refund Policy - New Choreography

New choreography orders are non-refundable. Work begins immediately after purchase and is undertaken in response to the customer's chosen song and order information. Standard and Express new choreography orders are therefore excluded from our voluntary 3-day refund policy. Nothing in this section removes any consumer right that applicable law says cannot be waived or excluded.

21. EU/UK and Other Mandatory Consumer Rights

Nothing in these Terms removes a cancellation, withdrawal, refund, consumer-guarantee, or other statutory right that cannot legally be excluded. Consumers in some locations, including the European Union and United Kingdom, may have statutory rights relating to online or digital purchases. Where required, checkout may need to obtain the customer's express request for immediate digital access or immediate commencement of a custom service and the legally required acknowledgment concerning any effect on statutory withdrawal rights.

22. Wedding Changes and Practice Time

Changing, postponing, or cancelling a wedding does not create an additional right to a refund. If a wedding is postponed, a customer with new-choreography access may contact us to request extension to the new wedding date. Customers are responsible for starting their lessons and allowing themselves enough practice time before the wedding. We cannot guarantee results where a customer delays practicing or does not allow sufficient practice time.

23. PHYSICAL ACTIVITY AND RISK OF INJURY

Dance is a physical activity and carries risk. Our lessons may include turns, spins, dips, lifts, balance changes, and other physical movements. Possible injuries can include falls, strains, sprains, collisions, muscle or joint injuries, and other harm. Customers are responsible for deciding whether they and their partner can safely attempt each movement.

24. CUSTOMER SAFETY RESPONSIBILITIES

Customers are responsible for using a safe practice space with enough room, a suitable floor, no unsafe obstacles, and appropriate footwear. Customers must not attempt any movement they do not feel confident, comfortable, or physically able to perform safely. If a movement causes pain, dizziness, discomfort, or feels unsafe, the customer should stop immediately and choose an easier option or request a substitute where available. Customers are responsible for telling us before choreography is created about relevant physical limitations or movements they do not want included. Anyone with an existing injury, medical condition, pregnancy, physical limitation, or other health concern should check with a qualified healthcare professional before starting the dance lessons or attempting the movements.

25. LIABILITY WAIVER AND ASSUMPTION OF RISK

By participating, the customer understands and voluntarily accepts the ordinary risks associated with learning, practicing, and performing dance, including lifts, dips, spins, and other movements. To the fullest extent permitted by applicable law, First Dance by Zienna LLC and its owners, employees, instructors, contractors, and representatives are not responsible for injuries, accidents, losses, or damages arising from a customer's voluntary participation in the dance activities or failure to follow the safety responsibilities in these Terms. Nothing in these Terms excludes liability that applicable law does not allow us to exclude.

26. Practice-Video Feedback

Where offered, customers may send practice videos for feedback without a stated numerical limit. Practice videos are used for providing the requested feedback and are not retained afterward. Sending a practice video does not give us permission to publish it or use it in marketing.

27. No Guaranteed Result

Our products are designed to be beginner-friendly, but every couple learns differently. We do not guarantee a particular performance, skill level, appearance, audience reaction, or result. Results depend on factors including practice, physical ability, comfort, available time, and use of the lessons.

28. Promotions

Discounted and promotional purchases are subject to the same Terms of Use and refund rules as full-price purchases unless we expressly state different terms for a particular offer.

29. Chargebacks and Payment Disputes

If a customer starts a chargeback or payment dispute, we may suspend access while the dispute is investigated. If the dispute is resolved in First Dance by Zienna's favor and the payment remains valid, access may be restored. If the dispute is resolved in the customer's favor and the payment is refunded, access will be permanently removed.

30. Honest Reviews

Customers are free to leave honest reviews, opinions, and criticism about their experience. Customers may not knowingly publish false statements of fact, impersonate another person, or fabricate claims about an experience they did not have. Nothing in this section is intended to restrict any legally protected consumer review or truthful statement.

31. Updates to Products

We may update, improve, replace, or reorganize lessons, videos, choreography presentation, and the platform experience over time, provided customers continue to receive the core access they purchased during the applicable access period.

32. Third-Party Services

We use third-party services including Thinkific and Stripe. Temporary outages or technical problems may sometimes occur. Customers experiencing an access problem should contact us so we can assist or provide a new access link where appropriate.

33. Informal Dispute Resolution

Before starting arbitration or other legal proceedings, the customer and First Dance by Zienna agree, where permitted by law, to first contact the other party and make a good-faith effort to resolve the dispute informally for at least 30 days.

34. Arbitration

After the 30-day informal-resolution period, disputes that cannot be resolved will, where legally permitted, be resolved through private, binding arbitration rather than a court trial. The arbitration provision, including the arbitration administrator, rules, location, fees, opt-out rights if required, and any legally required consumer disclosures, must be finalized with qualified legal counsel before publication.

35. Individual Claims and Class-Action Waiver

To the fullest extent legally permitted, disputes must be brought on an individual basis only. Neither party may bring or participate in a class, collective, consolidated, or representative action concerning a dispute covered by these Terms. This provision is subject to any rights that applicable law does not allow the parties to waive.

36. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without taking away mandatory consumer protections that apply to a customer and cannot legally be waived. Any court proceeding that is not subject to enforceable arbitration will, to the extent legally permitted, be brought in Florida.

37. Changes to These Terms

We may update these Terms in the future. The current version will be posted on our website with a new effective date. Updates will not remove rights that have already accrued or otherwise change rights where applicable law does not permit us to do so.

38. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.

39. Contact

Questions, refund requests, legal notices, account requests, and access support may be sent to First Dance by Zienna LLC, Florida, United States at [email protected].
